The new city council Bill LS 188 is being proposed by Councilman Dan Garodnick on the regulation of process servers. As of this moment, the Bill includes:
- Mandatory for All Agencies within the STATE of New York that distributes 5 or more service per year in New York City to be licensed with the New York City DCA
- Forces all servers and Agencies to be equipped with GPS systems that will need to be approved by the commissioner of DCA.
- Allows DEFENDANTS to sue process servers and agencies if they receive a judgment and feel they were served improperly for the full amount of the judgment, punitive damages, and legal fees.
- Records must now be kept electronically for 7 years including GPS records.
- Mandatory bonding of $10,000 for server and $100,000 for agencies.
